ELIMINATE SUBJECTIVE CONTINGENCIES

The Buyer has two exceptions to a non-contingent purchase:

  1. Re-Inspection
    1. 10 days to complete their own inspection to verify the Seller’s home inspection.
    2. If there is a significant undisclosed defect discovered in the foundation, structure, roof or major systems, or if mold is discovered, the Seller will correct the problem.
    3. Only if new, significant defects are found that the Seller refuses to correct will the buyer have the right to cancel and receive a refund of their deposit.
  2. Appraisal
    1. Appraisers are selected by a third-party Appraiser Management Company, and the lender is not involved. Hence, we cannot ensure we are getting a fully aware and knowledgeable Appraiser.
    2. If there is an error on the appraisal, it is nearly impossible to have corrected.
    3. If necessary, the Buyer must have sufficient capital to put down in order to cover a 5% shortfall in the appraisal.
